The Worldwide Visa Prepaid Debit Card Program - Terms and Conditions

THIS IS A STORED VALUE (PRE-PAID) CARD. YOU MUST DEPOSIT MONEY (FUNDS) ONTO YOUR CARD BEFORE YOU CAN USE IT! You cannot use this card before you add money to it – any purchases will be declined. Since this card is not a credit card, it can only be used if you have a positive balance on your account. It functions just like a debit card.

CARD ACTIVATION: Your card will arrive already activated for use.

Your card requires a Personal Identification Number (PIN) for use at ATMs and for pin-based
purchases at participating merchant locations.

1. Terms Of Use Agreement

THIS AGREEMENT IS BETWEEN you and the ISO whom is an authorized independent sales organization whose application form you have completed to purchase the card product. When you receive your card the card issuer will also send you their terms and conditions along with the instructions of how to load your card.

This Terms of Use Agreement ("Agreement") and any additional terms incorporated by reference govern your application for the Worldwide Visa Card and/or Worldwide MasterCard. This Agreement also constitutes the terms and conditions between you and the ISO ("ISO", "we", "us", or "our"), the intermediary for the Worldwide Prepaid Card Program. By applying for the Worldwide Visa Card and/or Worldwide MasterCard, you the Customer ("you" or "your") agree to be bound by all terms and conditions of this Agreement. If you have any questions concerning the program or your use of the Card, please contact your ISO. Please read this Agreement carefully and keep it for future reference.

2. The Worldwide Prepaid Program

The Worldwide Prepaid Program is an international card program involving several international card issuers and several international debit card processors. The program is developed to provide an opportunity for international clients to obtain a prepaid Visa or MasterCard.

3. Use Of The Card

The card is a renewable Prepaid Visa/MasterCard Debit Card. The value of the car depends on the amount of funds that you have transferred, deposited or loaded onto the Card. After the Card is issued and activated, you may use it to purchase goods and services anywhere Visa Cards are accepted and to access cash at ATMs or financial institutions displaying the name and/or logo of Visa/MasterCard, subject to the terms of this Agreement. The value available on the Card at any one time is limited to the dollar amount of prepaid funds, less withdrawals and amounts deducted for purchases and fees. Each time you use the Card to purchase goods or services, you authorize Bank to debit the Card. The Card and your obligations under this Agreement are non-assignable and non-transferable and the Card may be used only by the Cardholder or a Registered User. Furthermore, you agree that you shall: a. not use the Card to purchase illegal goods or services; b. promptly notify us of any loss or theft of the Card; and c. use the Card only as instructed. If the Card is used other than as permitted by this Agreement, to the extent permitted by law, Bank may, at its option and without waiving any of its rights, recognize the transactions and debit or credit the Card accordingly.

4. Eligibility for and Availability for the Worldwide Prepaid Program

Use of the Worldwide Prepaid Visa and MasterCard is limited to individuals who can lawfully enter into and form contracts under applicable law and have reached the age of maturity. We may refuse to provide the international prepaid visa Card to anyone, at any time, in our sole discretion. To receive the Worldwide Prepaid Visa or MasterCard, you must provide your real name, street address, e-mail address, telephone number and such other information as may be reasonably requested to determine your eligibility for the card. Falsification of any of this information constitutes grounds for termination of your account. The Worldwide Prepaid Program is available to applicants from all countries (except those blacklisted by the Office of Foreign Asset and Control (OFAC)) and is not subject to status, employment checks or any form of credit status check.

5. Mandatory Identification Required

The card is guaranteed on the basis that you complete the relevant information on the application form and are able to provide proof of identity via a current and valid passport, drivers license or national identity card. Once your receive your card you will have 28 days to provide a physical copy of you’re your ID as requested by your ISO or you card may be temporarily suspended. If your ID was issued in a country that has been black listed by the Office of Foreign Asset Control (OFAC), Financial Action Task Force (FATF) or from a region deemed to be high risk then you may be requested to provide proof of residence along with your application.

6. Banned Countries

Even though the Worldwide Prepaid Program is an international card distribution program the card issuers on this program are highly astute in ensuring they are compliant with international trading laws and as such there countries who may be excluded from this program for political and security reasons should such a need arise. Cards cannot be distributed to the Balkans, Burma, Cuba, Iran, Iraq, Liberia, Libya, North Korea, Sudan, Syria and certain parts of Africa like Nigeria and South East Asia. If you are an applicant from Africa or South East Asia please first contact your ISO so that they can check regarding the status of card delivery to your country.

7. Privacy Policy

As part of the application process your application information will be passed to the card issuer in order for your card to be printed and dispatched.

We may also disclose information to third parties about your account or the transfers you make:

1. Where it is necessary to service your account, or
2. In order to verify the existence and condition of your account for a third party, such as a
merchant or bank
3. For security purposes, fraud deterrence, and when necessary to prevent identity theft, or
4. In order to comply with government agency or court subpoenas and/or orders, or
5. If you give us your written permission, or
6. In accordance with Privacy Policy.

The card issuers and processors on this program will cooperate completely with all law enforcement agencies in the pursuit of fraud, with regard to the purchase and use of this card product or in respects to card behavioral patterns which fit the profile for money laundering. In such events cards will be automatically suspended pending further investigation.

8. Fees and Refund Policy

You agree to pay the ISO application fee associated with your purchase of your Worldwide Visa . The card will be delivered within 3 weeks from time that your payment has cleared. You reserve the right to request a refund within 7 days of your initial agreement. After this 7 days there will be no refunds unless we are unable to provide your card within a maximum of 6 weeks to which you can request a refund or to be placed with an alternative product. Refunds to you account are made by cheque/bankers draft and mailed to the address on your application form or, at our option electronically deposited back into your account. In either case please allow thirty (30) days for any qualifying refund to be received.

9. Card Online Access

You will be able to access your card balance through the card issuers online account system. The
details of the online account are provided to you when you receive your card package.

10. Adding Funds to Your Worldwide Prepaid Visa/MasterCard International Reloading Options

MoneyGram Payment – Any MoneyGram payment location can initiate a funding transaction to an account.

UK NatWest Bank – Customers are able to make cash deposits onto their card through several NatWest Bank location throughout the UK (applicable to loading within the UK only)

Bank Wire Swift / Iban – Cardholders can load their card by using the services of money trasfer company 'TrasOpt Ltd'. To load your Visa card using TransOpt, visit your bank and request that the cashier completes a paying-in slip and quotes your 16 digit card number and name withint the narrative or reference area.

ACH – Conventional “pay by check” feature for electronic/online check presenting and funding of

12. Funding Limits

1. The Prepaid Visa/MasterCard can hold a maximum of $10,000 at any one time
2. The Prepaid Visa/MasterCard ATM Withdrawal limit is $500 but this is subject to ATM network regulations on maximum withdrawals.
3. The Prepaid Visa/MasterCard cash advance limit is $2000

13. Foreign Exchange/ Currency Conversion

If you use the Card for Visa transactions in a currency other than U.S. Dollars, the transactions will be converted by Visa, to U.S. Dollars, generally using Visa authorized rates, in effect from time to time. You agree to accept the converted amount in U.S. Dollars.

14. Recurring Transactions:

The Card is not ideal for recurring transactions. “Recurring Transactions” are transactions that are automatically charged to your Card each month with or without your knowledge. Examples of merchants that may use recurring transactions include Internet service providers, health clubs, insurance companies that automatically charge monthly premiums to the Card, “Book of the Month Club” type merchants, cable TV services and the like. Because the Card is prepaid and does not carry a credit line, these merchants may suspend or cancel your service if you don’t have enough value left on the Card when that recurring transaction comes due. This could be dangerous if the recurring charge is for an essential service. If you purchased the Card to use specifically at these types of merchants, you may not be satisfied with the Card as it is not suitable for this type of transaction. Any card cancellations shall be made pursuant to the provisions of this agreement.

15. Services And Products Illegal For Minors:

Certain brands of prepaid products sold are designed to be used by people of all ages, excluding minors. Therefore, the Card may be accepted by certain types of merchants whose products and services are not legal for minors. Examples of such merchants include casinos, gambling web sites, pornography merchants and certain other merchants categorized as not legal for minors. If you purchased the Card to use specifically at these types of merchants, you may not be satisfied with the Card as it is not suitable for this type of merchant. Any card cancellations shall be made pursuant to the provisions of this Agreement.

16. Open End Transactions:

There are certain types of merchants that sell goods or services where the final amount they will charge to the Card is unknown at the time they first authorize the Card. Typical merchants in this category include rental car companies, hotels, Internet service providers, certain time -based or variable cost merchants and others where the final purchase amount is not known up front. Therefore, the Card may be “authorized” or “have funds held” for more than the actual amount of the purchase until the final transaction is complete — meaning that those “authorized dollars” are not available for you to spend elsewhere. Furthermore, transactions at certain merchants that authorize high dollar amounts, especially rental car companies and hotels, may cause a “authorization” or a “hold” on your available balance for up to 90 days — meaning you won’t have access to the authorized dollar amount of these funds during that entire time. This is done to prevent fraud by Card users who may run up a bill higher than the amount first approved. Please note that we cannot manually release legitimate authorizations without a certified letter or fax from the merchant. Furthermore, should you request that we manually release a legitimate authorization, a research and/or special service fee will apply in the amount set forth on the schedule of fees attached hereto. If you purchased the Card to use specifically at these types of merchants, you may not be satisfied with the Card as it is not suitable for this type of merchant. Any card cancellations shall be made pursuant to the provisions of this Agreement .

17. Change Of Address:

If your mailing address changes, you must notify Customer Service immediately. Failure to do so may result in information regarding the Card being mailed to the wrong person or your transactions being declined at the point-of-sale. In such event, we shall not be responsible for any resulting misuse of value on the Card. Any notice given by Bank shall be deemed given to you if mailed to you at the last mail address for the Card furnished by you to the Bank or Authorized Service Provider.

18. Lost or Stolen Cards:

You understand that your Card is a stored value card and is not protected by laws covering credit cards. To the extent permitted by applicable law, the card issuer is not responsible for lost or stolen Cards or any unauthorized transactions made with the Card. If you believe your Card is lost or stolen deactivate your card by calling the Customer Service Number on the back of your card immediately.

Telephoning Customer Service immediately is the best way to minimize your possible losses. If you fail to notify Customer Service promptly and you are grossly negligent or fraudulent in the handling of the Card, you could lose all the money on the Card. See the section entitled “Your Liability for Unauthorized Transfers” in this Agreement for additional information concerning your liability for unauthorized transfers. You also agree, to the extent permitted by law, to cooperate completely with the Card Issuer in their attempts to recover from unauthorized users and to assist in their prosecution.

19. Liability For Unauthorized Transfers:

Inform Customer Service AT ONCE if you believe your Card has been lost or stolen or that someone has transferred or may transfer money from your Card account without your permission by contacting Customer Service at the phone number on the back of your card. Please make a note of this phone number and keep it in a place separate and safe from unauthorized use. You could lose all the value on the Card. Also, you are responsible for verifying the information on your periodic statements online.

20. Liability For Failure To Make Transfers:

If the Card Issuer does not complete a transaction to or from the Card on time or in the correct amount according to our Agreement with you, we may be liable for your losses or damages. However, there are some exceptions. We will not be liable, for instance if: a. through no fault of ours, you do not have enough value on the Card to complete the transaction; b. through no fault of ours, a Merchant refuses to honor the Card; c. circumstances beyond our control (such as fire, flood, terrorist attack, national emergency or any acts of God) prevent the transaction, despite reasonable precautions that we have taken; d. you attempt to use a Card that has not been properly activated; e. a Merchant where the Card was either purchased or loaded did not properly transmit information to the Authorized Service Provider; f. an ATM where you are making a cash withdrawal does not have enough cash; g. access to your Card has been blocked after you reported your Card lost or stolen; h. If there is a hold or your funds are subject to a legal process or other encumbrance restricting their use; i. we have reason to believe the requested transaction was unauthorized; or j. any other exceptions stated in this Agreement.

21. Ombudsman Card Issuer Process

The Card issuers have processes in place to ensure that card holder complaints can be carefully monitored and processed in an appropriate manner. All participating banks have details on their websites of their process for complaint procedures and escalation.

22. Complaints Procedures

The ISO Complaint procedures is as follows.

1) Applicants must send an official letter to ISO detailing their complaint, query or concern.
2) ISO will then within 4 days issue a letter of acknowledgement and confirm that the case is being looked into.
3) ISO will then within 2 weeks of receiving the official letter respond by letter with a resolution to the complaint, query or concern.
4) If you are unhappy with the resolution offered by ISO then you should approach the card issuer with an official letter of complaint.
5) If you are still not happy then you should write to the regulatory body which authorizes and regulates the ISO.

23. Non-Assign ability

You may not assign or transfer this Agreement or any of your respective rights, obligations, duties, responsibilities or liabilities under this Agreement, and any attempt to the contrary shall be null and void. This Agreement shall be binding on you and your respective executors and administrators.

24. Consent To Jurisdiction

The parties agree that the validity construction and performance of this Agreement to be governed by the Laws of England to which the Contracting Parties submit themselves.
